Mobile application privacy policy

Privacy Policy and Personal Data Protection in the Poland Business Run mobile application

Dear User,

As of May 25, 2018, all entities processing personal data are required to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as GDPR).

In connection with the above, the administrator of this application called Poland Business Run ("Application"), which is the Poland Business Run Foundation with its registered office at 17/2 Siemiradzkiego Street, 31-137 Kraków ("Administrator"), to fulfill the information obligation specified in Articles 12 and 13 of the GDPR, informs that within the application, the following Privacy Policy is applied:

General Information

1. The Privacy Policy defines the principles of processing and protecting personal data provided by Users in connection with their use of the Poland Business Run Application available in the Google Play Store and Apple Appstore.

2. The administrator of your personal data is the Poland Business Run Foundation with its registered office in Kraków (31-137), 17/2 Siemiradzkiego Street, REGON: 364424465, NIP: 6762507232, entered in the register of associations, other social and professional organizations, foundations, and independent public health care institutions of the National Court Register under number KRS 0000617320, whose registration files are kept by the District Court for Kraków - Śródmieście in Kraków, XI Commercial Division of the National Court Register. Contact with the Administrator is possible via traditional mail by writing to the Administrator's registered office address and via email by writing to: [email protected].

3. The Administrator has appointed a Data Protection Officer, who can be contacted at the email address: [email protected].

4. In order to ensure the security of the personal data entrusted to us, we have implemented procedures to prevent data security breaches. The applicable procedures comply with the applicable law, in particular with:

a) Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC,

b) The Personal Data Protection Act of May 10, 2018,

c) The Act on the Provision of Electronic Services of July 18, 2002.

5. Personal data may be processed by us based on the consent expressed by the User, and in cases where the law authorizes us to process personal data in order to perform the contract concluded between the parties, based on legal provisions, or when processing is necessary for purposes resulting from legitimate interests pursued by us as the Administrator.

6. The personal data of application users are processed for the following purposes:

- registration of Poland Business Run race results based on the contract concluded by accepting the race regulations (legal basis: Article 6(1)(b) of the GDPR),

- creating and maintaining a user account in the application in accordance with the application regulations, including for the purpose of maintaining rankings and corporate sports competitions and enabling the proper functioning of the site (legal basis: Article 6(1)(a), (b), and (f) of the GDPR),

- necessary contact with users, including sending notifications regarding the operation of the application (legal basis: Article 6(1)(f) of the GDPR),

- analyzing the quality of services provided to improve their functionality and conducting usage statistics of the application (legal basis: Article 6(1)(f) of the GDPR),

- conducting promotional, informational, and marketing activities related to the Administrator's activities (legal basis: Article 6(1)(a) of the GDPR, the Act of July 12, 2024, on Electronic Communications Law).

7. Providing data is voluntary but necessary to achieve the purposes mentioned above.

8. The mobile application may have access to:

  • Location,
  • Internal device memory,

if the user consents to it.

Collection and Processing of Personal Data

1. The application performs functions of obtaining information about Users and their behaviors during the download of the application, registration of accounts, and use of the application. Registration is not mandatory. However, please note that you may not be able to use some of the features offered by the Application if you do not register. The Administrator may also use the provided information for contact, providing important information, required notifications, and conducting marketing activities.

2. The application may automatically collect certain information, including but not limited to, the type of mobile device used, the unique identifier of the mobile device, the IP address of the mobile device, the operating system of the mobile device, the type of web browsers used, and information on how the Application is used.

3. The user may be asked to provide the following personal data in the application: email address, first and last name, organization name, profile picture. Some of the entered information may be publicly visible to other Users.

4. This Application, with prior consent, collects the location of your device, which helps the Administrator determine your approximate geographical location and use it in the following ways:

a) Geolocation services: The Administrator uses location data in accordance with the purpose of the application to provide features for recording physical activities and maintaining User rankings.

b) Analytics and improvements: Aggregated and anonymized location data help the Service Provider analyze user behaviors, identify trends, and improve the overall performance and functionality of the Application.

c) Third-party services: Periodically, the Service Provider may transfer anonymized location data to external services. These services help them improve the Application and optimize the offer.

5. The application does not use AI, AI-powered systems or language models (LLM) for data processing.

6. Your personal data may be transferred to entities authorized under the law and entities processing personal data on behalf of the Administrator, e.g., IT service providers and other entities processing data for purposes specified by the Administrator - provided that such entities process data solely based on a contract with the Administrator.

7. Only aggregated and anonymized personal data of users may be periodically transferred to external services and third countries or international organizations to help the Administrator improve the Application in the following cases:

a) when required by law,

b) to protect the rights and safety of users,

c) to entities providing IT services on behalf of the Administrator, which do not have the right to use the data independently.

8. The application uses third-party services that have their own Privacy Policies regarding the processing of personal data. These services are:

a) Google Play Services

b) Apple App Store

c) MapBox

d) Amazon Web Services

e) Firebase

f) Garmin

User Rights

1. The User of the Application has the right to:

a) Access the content of their personal data, i.e., the right to obtain confirmation whether the Administrator processes the data and information regarding such processing,

b) The right to rectify data if the data processed by the Administrator is incorrect or incomplete,

c) Deletion or restriction of the processing of personal data,

d) Data portability,

e) Object to the processing of data based on the legitimate interest of the Administrator or to processing for direct marketing purposes,

f) Withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal - if the processing is based on the consent given to the Administrator,

in cases and under the conditions specified in the General Regulation. The rights mentioned above can be exercised by contacting the Poland Business Run Foundation, email: [email protected].

2. Your personal data will be stored in the database for the period necessary to perform the contract, and then for the period of possible claims, but no longer than 6 years.

3. You have the right to lodge a complaint with the President of the Personal Data Protection Office in Poland if it is justified that your personal data is processed by the administrator in violation of the provisions of the General Regulation.

Final Provisions

1. We reserve the right to change the Privacy Policy, which may be influenced by the development of internet technology, possible changes in data protection law, and the development of the Application. We will inform about all changes in a visible and understandable manner.
